These Terms of Service govern your access to and use of HahaMusic. By accessing, downloading, or using the Service, you agree to be bound by these Terms.
HahaMusic is an online service intended for adults aged 18 or older.
You must be at least 18 years old to use HahaMusic. By using the Service, you represent and warrant that you meet this requirement.
The Service is intended for personal, non-commercial use unless otherwise agreed in writing.
All rights, title, and interest in and to the HahaMusic platform, including the app, website, design, trademarks, logos, software, audio models, databases, and intellectual property, are owned by HahaMusic.
You may not:
- Copy, modify, reverse engineer, decompile, or attempt to extract source code
- Reproduce or exploit any part of the Service without permission
- Use our trademarks without written consent
You are solely responsible for any content you submit, upload, create, or share through the Service, including names, messages, voice recordings, images, and generated outputs.
You represent and warrant that:
- You have the legal right to use and submit the content
- Your content does not infringe any third-party rights
- Your content does not violate any law
- Your content is not defamatory, abusive, obscene, or unlawful
HahaMusic does not pre-screen all user content and does not endorse user-generated content.
We reserve the right, but are not obligated, to remove or restrict content that violates these Terms or applicable law.
To the maximum extent permitted by law, HahaMusic is not responsible for user-generated content.
You retain ownership of your content.
By submitting or generating content through the Service, you grant HahaMusic a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting or technical purposes), and display that content solely as necessary to provide, maintain, and improve the Service.
This license ends when your content is deleted from our systems, except where retention is required by law.
HahaMusic uses automated and AI-based technologies to generate songs, artwork, and related outputs.
You acknowledge that:
- Outputs are generated automatically based on your inputs
- Results may vary in quality or style
- Generated content may not be unique
- We do not guarantee that generated content is error-free or suitable for any specific purpose
You are responsible for reviewing all generated content before sharing or using it publicly.
The Service is provided for entertainment and personal creative purposes only.
You agree not to use the Service to:
- Violate any law
- Infringe intellectual property rights
- Impersonate others
- Generate unlawful, abusive, or harmful content
- Upload malicious software
- Interfere with the normal operation of the Service
We may suspend or terminate accounts that violate these rules.
HahaMusic may offer digital credits or digital content for purchase.
Because digital goods are delivered immediately or consumed upon use:
- All sales are final once delivery begins or credits are used
- Refunds are provided only where required by applicable law
- In case of verified technical failure on our side, we may issue replacement credits or a refund at our discretion
If a purchase was made through an app store, that platform’s refund policy may apply.
Nothing in these Terms limits mandatory consumer rights under applicable law.
Generated content and uploads may be retained for a limited period, such as six months from creation.
We do not guarantee recovery of content after deletion or after the retention period expires.
Users are responsible for saving copies of any content they wish to keep.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
We are not liable for losses resulting from unauthorized access caused by your failure to secure your credentials.
The Service may integrate or link to third-party providers, including payment processors, hosting providers, analytics services, and content-generation tools.
We are not responsible for the availability, accuracy, or practices of third-party services.
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, HahaMusic disclaims all warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Availability without interruption
We do not guarantee that the Service will be error-free, secure, or uninterrupted.
To the maximum extent permitted by law:
HahaMusic shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.
Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.
Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
You agree to indemnify and hold harmless HahaMusic and its operators from any claims, damages, liabilities, and expenses arising from:
- Your content
- Your misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights
We may suspend or terminate your access to the Service at any time for violation of these Terms or for security or operational reasons.
Termination does not affect rights or obligations that accrued before termination.
These Terms are governed by the laws of Estonia, without regard to conflict of law principles.
If you are a consumer residing in the United States, mandatory consumer protection laws of your state may apply.
Any disputes arising out of or relating to the Service shall be resolved in the courts of Estonia, unless otherwise required by mandatory consumer protection laws.
We may update these Terms from time to time. Updated Terms will be posted with a revised “Last Updated” date.
Continued use of the Service after changes constitutes acceptance of the updated Terms.
